An Bórd Pleanála has refused planning permission for a major housing development in Tralee.
KPH Construction was granted permission by Kerry County Council last year to build 256 housing units on a site in Clash, across from the former racecourse.
In November, the decision was appealed to the planning body by locals, with claims there are health and safety issues with the access to the site onto Clash Road.
The proposed development would include the construction of 138 semi-detached and terraced houses, 118 maisonette units over two-storeys ; a two-storey creche on-site, as well as over 240 car parking spaces.
An appeal lodged to An Bórd Pleanála in November, cited claims of health and safety issues with site access.
It also raised concerns about the necessity to set back front boundary walls of existing, adjoining properties to allow for sight lines and a cycle lane at the site exit.
In its refusal, the planning body found the layout and design of the maisonettes to be poorly considered with respect to private/communal amenities.
An Bórd Pleanála stated there is a lack of communal open space within these units, and the quality of private open space would not compensate for this.
It said this would result in a substandard level of amenity for future residents.
The planning body stated the development conflicts with the provisions of the Kerry County Development Plan (2022-2028), and would be contrary to the proper planning and sustainable development of the area.
