Teenager accused of producing machetes in Tralee assault may avoid custodial sentence

A teenager accused of producing two machetes in an assault in Tralee may avoid a custodial sentence, if consensus can be reached between Tusla and the Probation Services.

The 17-year-old boy, who cannot be named by order of the court, appeared before Judge David Waters via video-link from Oberstown Children Detention Campus.

He faces three charges in relation to an alleged incident at Tralee Community Training Centre in Monavalley Industrial Estate on September 23rd, and is yet to indicate a plea.

The teenager is accused of assaulting another male, producing two machete knives during the alleged assault, and possession of two machetes while intending to unlawfully cause injury to another person.

At Tralee District Court, the teen’s solicitor, Padraig O’Connell referenced the probation report which stated the accused presented insight and remorse.

Judge David Waters replied that what jumped out to him from the report, was the very high risk of reoffending and that the teen has no place to go.

A youth social worker informed the judge that accommodation had been sourced for the boy, however, they would not accept him due to risk.

They advised that an aftercare worker is in place for the teen, who is working on an aftercare plan with him.

Judge Waters stated the alleged offences call for a custodial sentence if the teenager is convicted, but, he would consider an alternative, if consensus can be agreed between the Child and Family Agency and the probation services.

The judge added he has concerns in relation to violence, however, there are positives - as the accused appears to be willing to work with the probation services.

He further remanded the teenager in detention at Oberstown, to appear before the court again next week.
