The District Court judge in Tralee is to hear full facts of allegations of a violent assault against a Killarney man, to decide on jurisdiction in the case.
33-year-old Jonathan O’Brien of 2, Hazelwood Drive, Ballyspillane, Killarney, faces three charges relating to one incident in Ballyspillane on 16th April.
Mr O’Brien appeared in Tralee District Court this week before Judge David Waters.
Mr O’Brien first appeared in court in Dublin last week, as no court was available in Munster for his appearance after he was charged.
He’s accused of assault causing harm, damaging a sliding glass door and television, and producing a scalpel blade in the course of a fight.
His solicitor Pádraig O’Connell told the court this week that it had been indicated further charges will be brought against his client.
Sergeant Chris Manton said directions from the Director of Public Prosecutions were not available yet.
Judge Waters remanded Mr O’Brien to 7th May, and the judge asked that he be given the full facts of the allegations on that date to decide on jurisdiction.
After he hears the nature of what’s alleged, Judge Waters may refuse jurisdiction, meaning that Mr O’Brien’s case would not be heard in the District Court.
It would then be up to the DPP to direct in which higher court Mr O’Brien would be tried, such as the Circuit or Central Criminal Court.
Mr O’Brien was remanded in continuing custody, as he has not applied for bail.
