A date has been set to hear a High Court challenge taken by a Kerry Sinn Féin TD against the Government’s appointments of Super Junior Ministers.
Deputy Pa Daly claims that Fianna Fáil and Fine Gael have increased the Cabinet to nineteen through the backdoor, when the Constitution states it can’t exceed fifteen.
Deputy Pa Daly says there is urgent need for legal clarity on this issue.
Mr Justice Barniville has fixed a hearing date for the case for July 7th.
The Kerry TD says he is welcoming the fact that President of the High Court, Mr Justice David Barniville has granted a full hearing and has fixed a date for the case to proceed.
Deputy Pa Daly says he is challenging the Government’s decision to appoint nineteen Super Junior Ministers; he adds that it’s his view that this approach breaches the constitution and believes it’s crucial that we obtain legal clarity on this once and for all.
He says it’s a very significant step forward and he looks forward to establishing clarity on what he believes is an unconstitutional action by the Government.
