The planning appeals board has refused to grant planning retention to a business whose directors include Cllr Johnny Healy-Rae.
An Taisce appealed to An Coimisiún Pleanála after Kerry County Council granted planning retention to Sunville Construction Ltd to continue operating a quarry at Rossacroo Wood near Kilgarvan.
Kerry County Council had granted retention permission to retain a previously quarried area of 2.2 hectares, equating to more than five acres, at Rossacroo Wood, Crohane, Clonkeen.
The council also granted permission to Kilgarvan company Sunville Construction to continue aggregate processing activities there; likewise subject to conditions.
Cllr Johnny Healy-Rae and his brother Daniel are directors of Sunville Construction.
An Coimisiún Pleanála upheld An Taisce’s appeal against the council’s decision.
The planning commissioner said the commission couldn’t be satisfied that the developments would not have a significant effect on Killarney National Park, McGillycuddy’s Reeks and Caragh River Catchment Special Area of Conservation.
He also said in his report the commission couldn’t be satisfied that the developments would not result in deteriorating quality at the Loo River.
A spokesperson for Sunville Construction said the company would review the decision.
