Fine Gael Senator Mike Kennelly has called on the Minister for Justice to address the Seanad about election fraud and referenced a case of voter fraud in South Kerry.
The Kerry senator raised concerns about the outcome of a case in Kenmare Court last Friday when it emerged that gardaí had not questioned a man who pleaded guilty to voting using a polling card that was not in his name.
Last Friday, 29-year-old David Moriarty of Kilmackerin, Cahersiveen pleaded guilty to a charge that on June 7th, 2024 he fraudulently put in a ballot box a paper other than a ballot paper you were "authorised by law to put in” contrary to section 138 of the Election Act.
Mr Moriarty avoided a conviction and was ordered to pay €1,000 to charity.
Responding to concerns raised about case, An Garda Siochana, the Department of Justice and the Election Commission all declined to comment.
Speaking in the Seanad, Senator Kennelly, who's from Listowel, said the case requires examination.
