A Kerry county councillor has claimed the local authority is in breach of its own planning rules by not having a footpath built in Barraduff.
Fianna Fáil councillor Niall Kelleher raised the matter at the recent Killarney Municipal District meeting.
The council’s reply to him was that it is a matter to be resolved by the developer and the planning authority.
Cllr Kelleher tabled a motion at the recent Killarney Municipal District meeting, in which he said the footpath by the Barraduff garda station hasn’t been opened.
The footpath is serving the social housing development in Barraduff.
He also claimed that Kerry County Council is in breach of its own planning rules by housing social housing applicants in the houses without the footpath being open.
He acknowledged a lot of work had been done and welcomed the progress with Transport Infrastructure Ireland for the safety improvement scheme in Barraduff.
Cllr Kelleher said it was a condition of planning that the footpath would be open within three months of construction starting, on a development which had now been completed.
The Fianna Fáil councillor said it’s absolutely unjustifiable the footpath isn’t open yet, and it was time to bang heads together and get it done.
Kerry County Council said technical approval will be sough from TII in the first quarter this year for the overall safety improvement scheme, of which the footpath is one part.
It said in parallel, Kerry County Council is engaging with relevant landowners to link this location to nearby footpaths.
It said any issues with regard to compliance with planning conditions is a matter to be resolved by the developer and the planning authority.
The developer, Co-operative Housing Ireland, did not respond to queries from Radio Kerry.
Cllr Kelleher asked the Killarney MD Manager, Martin O’Donoghue, to personally get involved; Mr O’Donoghue said he could not do this as he is not going to prejudice any planning compliance matter.
Cllr Kelleher said there’s no prejudice, and urged the council to “just get the bloody thing opened”.
