Kerry County Council launched 20 Part V enforcement actions against developers over five years

Kerry County Council have launched 20 Part V enforcement actions against developers in the past five years.

According to the Journal.ie this is the most of any local authority in the country.

Part V of the Planning and Development Act, requires a percentage of new housing developments to be allocated for social and affordable housing.

A total of 61 Part V enforcement cases were taken by local authorities against developers nationwide, between 2020 and 2025.

Figures from the Journal Investigates show 32% of these were in Kerry.

Kerry County Council opened two enforcement cases in 2020, one in 2021, six were taken in 2022 - the highest number in a year.

A further four actions were opened by the local authority in 2023, five in 2024, and two last year.

The data shows a case in the county from 2021 remains open and unresolved, even with an enforcement notice being served in 2023.

Meanwhile, 118 social housing units in Kerry were acquired by the council from private developers in relation to Part V, in the five year period.

26 in 2020, six in 2021, 24 in 2022, 16 in 2023, 18 in 2024, and 28 were acquired up to the third quarter of 2025.
