Judge orders fencing erected on Fenit Island be removed

A judge has ordered that fencing erected on Fenit Island has to be removed.

Kerry County Council took action under Section 160 of the Planning and Development Act against three landowners, who had erected unauthorised fencing on Fenit Island.

This matter has been ongoing for several years, and the case was heard before Judge Colin Daly at Tralee Circuit Court this week

All cases were settled and the council was granted orders requiring the unauthorised sections of fencing be removed, with a nine month stay, and a contribution was agreed towards the council’s costs.
