130 enforcement notices and warning letters issued for unauthorised development in Killarney MD

130 enforcement notices and warning letters have been issued in the Killarney Municipal District area in the past 18 months.

The correspondence is sent by Kerry County Council in relation to unauthorised development.

The figures were issued following a motion by Killarney MD Cathaoirleach, Cllr Marie Moloney.

Under the Planning and Development Act, Kerry County Council has a range of powers to deal with unauthorised development.

A warning letter is served within six weeks of the receipt of a complaint with the recipient given four weeks to respond; if none is received an enforcement notice can be served.

Failing to comply with this notice can result in legal proceedings in the circuit court through a Section 160.

Last year in the Killarney Municipal District, 47 warning letters were issued, 35 are ongoing, all nine enforcement orders served are ongoing, as is a single Section 160 injunction.

In the first six months of this year, 73 warning letters were served, 71 are ongoing with 57 relating to short-term letting, a single enforcement order is also ongoing.
