A Tralee family has settled its High Court actions arising from an accident at the Circuit of Kerry rally ten years ago.
The court heard that Jamie O’Brien who was two years old at the time was extremely lucky that he was not strapped into his buggy.
On April 19th, 2015, the then toddler was watching the rally with his parents and sister at a church car park in Ballymacelligott when a car on the Circuit of Kerry rally went out of control.
The car went through a protective barrier and threw the buggy up against a wall.
The O’Briens’ senior counsel told the court that Jamie who’s now aged 12 had been left with scars on his head and over his eyebrow.
The boy settled his action for €75,000.
The car also struck his sister Megan, who was seven years old at the time, and drove her back into the corner of the car park wall.
Counsel said that Olivia and Alan O’Brien thought their daughter was dead; she was airlifted to CUH.
She was in ICU and had to have four different surgeries.
Counsel said Megan, who’s now 17, had made a full recovery and settled her action for €250,000.
The four members of the O’Brien family had sued the driver of the car David Murphy of Coole West, Athea, Co Limerick along with Tralee Autosports Co Ltd trading as Kerry Motor Club with registered offices at Knockmoyle, Tralee and Motorsport Ireland with offices at Dawson Street, Dublin, and Kerry County Council.
Mr Justice Paul Coffey was told that the actions brought by Mr and Mrs O’Brien had been settled and could be struck out.
The terms of the settlement are confidential.
