A 36-year-old man has appeared in court accused of a violent, unprovoked attack on his ex-partner in East Kerry.
Oleksander Gulas, with an address in Barraduff, was granted bail by Judge David Waters at Tralee District Court, but he must stay away from Barraduff.
The court was told that the state is considering bringing further charges against Mr Gulas.
Gardaí allege that Mr Gulas assaulted his ex-partner at the home they shared in Barraduff, on 23rd September, causing her harm.
Sergeant Chris Manton said directions from the DPP are not yet available, but further charges are being considered.
Gardaí objected to Mr Gulas being released on bail, outlining their concerns at the seriousness of the alleged offending.
The court heard that Mr Gulas is alleged to have grabbed his ex-partner by the throat and choked her for around 30 seconds, before throwing her against a closet and slapping her in the face.
Gardaí told the court they believe Mr Gulas would be a danger to his ex-partner if admitted to bail, and they are afraid he would seek retribution for her making a criminal complaint.
Judge David Waters asked for specific evidence that would lead to these concerns, adding that if there is no evidence pointing to Mr Gulas seeking retribution, the High Court would grant him bail in a heartbeat.
Judge Waters said he will attach conditions to bail, and asked if Mr Gulas would be able to provide an address.
His solicitor Brendan Ahern told the court his client is a Ukrainian refugee who previously stayed in a hostel, and he is actively seeking to find accommodation.
Judge Waters remanded Mr Gulas on bail on his own bond of €200, to appear again in Tralee District Court on 22nd October for DPP directions.
As part of the bail conditions, he must not have any contact, direct or indirect, with the alleged injured party, he must stay out of Barraduff, and be available to gardaí by phone at all times on an agreed phone number.
