Planning issue about Fossa gate to be subject of judicial review

A planning issue surrounding a gate erected across a lane leading to one of Killarney’s lakes, is to be the subject of a judicial review.

Last month An Bord Pleanala ruled that the gate, located on a lane south of Fossa Village, off the N72 Ring of Kerry road, is development.

The case had been referred by Kerry County Council, asking it to determine if the erection of a gate by Cornelius Anthony Dennehy, is or is not development or is or is not exempt development.

It had been claimed there’s public, personal and commercial interest in the road, with access for houses, a hotel and agricultural lands, and that the road is owned by three parties.

Mr Dennehy was yesterday granted an application in the High Court to seek a judicial review of the decision.
