Garda error may cause road traffic case to be challenged

The case against an American tourist, charged with a road traffic offence after colliding with the State car of the Minister Eamon O Cuiv outside Killarney, may be challenged because of an error on a Garda charge sheet. Up to 20 Garda summonses have been adjourned at Killarney District Court because of ambiguity surrounding the title of the court area on the summonses.Judge James O Connor who adjourned the cases said that the title on the cover sheet stating District Court Number 17 raised a question concerning jurisdiction, as District Number 17 was the proper designation. At the request of Judge O Connor, Killarney solicitor Padraig O’ Connell is to take a consultative case to the High Court to seek clarification. 56 year old John Corbett with an address in Missouri has been summonsed on a charge of driving in a manner dangerous to the public in relation to the incident with Minister O Cuivs car.
