An Taisce to appeal court ruling on major west Kerry road scheme

An Taisce has decided to appeal a ruling by the Commercial Court relating to a west Kerry road scheme. An Taisce Radio Kerry News has learned the national heritage trust is planning to appeal the decision which was handed down by the court on October 7th. The 65 million euro scheme in West Kerry, which was previously the subject of an extensive oral hearing, seeks to straighten and improve the road from Dingle to Annascaul and from Gortbreagoge to Camp. An Taisce said the route is renowned for its scenic quality and heritage and sought to have the decision by the planning appeals board quashed. The challenge was defended by An Bord Pleanala and Kerry County Council. Mr Justice Robert Haughton dismissed the legal challenge; An Taisce had two weeks in which to lodge an appeal. Radio Kerry News has learned the group has today decided to appeal the ruling of Mr Justice Haughton to the Court of Appeal. It’s not known at this stage how long the appeal will take and what impact it will have on any proposed start date for the already long delayed road project.
