22 year man old charged with assault is denied bail

22 year old Michael Mc Carthy from Cois Coille in Tralee has been denied bail at a sitting of Tralee District Court today. A charge of assault was brought against Mr Mc Carthy after the death of 43 year old Michael Faulkner in The Mitchels area of the town last month. Judge Humphrey Kelleher refused an application for bail and remanded Mr Mc Carthy in custody to appear in court in Cork in a fortnight`s time.Michael Mc Carthy was charged with assault under section 3 of the non fatal offences against the person at a special sitting of Kenmare District Court last Saturday. During today`s hearing a casually dressed Mr Mc Carthy gave evidence that he is 22 years of age, married with one child. When asked by his Solicitor Pat Mann, Mr Mc Carthy said if he got bail he would comply with any conditions imposed. He also answered that he would give an undertaking to stay away from the family of the deceased man.Mr Mc Carthy’s father in law gave evidence that he would be prepared to place a cash bond with the court as part of any bail conditions. Superintendent Pat O Sullivan told The Court Gardai are opposed to any bail. Judge Humphrey Kelleher refused bail and remanded Mr Mc Carthy to appear again at Cork District Court on October 6th.
