Tralee Town Council says it’s taking legal proceedings against a restaurant owned by football legend Mick O Dwyer for breach of planning permission. Town Clerk Mike Scannell has confirmed its counsel is preparing a case against the Supermac’s restaurant in the Mall. Tralee Town Council alleges the takeaway is operating outside of the opening hours granted in its planning permission. In August last year, The Local Authority served the owners of Supermacs with an enforcement notice, ordering immediate compliance or risk legal action. However, in the meantime, no further action was taken. Mr scannell says this delay was because the Council was awaiting legal advice as to whether it could proceed with a prosecution. He says the County Solicitor is issuing legal proceedings but did not give a time frame. The restaurants owners deny they are in breach, saying they believe their hours of business comply with their planning permission.
