Stephan O’Shea, who has 46 previous convictions, attacked the man in a ‘violent, unprovoked and gratuitous’ assault, Tralee Circuit Criminal Court heard.

Judge Tom O’Donnell described the attack as ‘an opportunistic attack on a defenceless man’ that had happened after a violent incident.

He accepted the accused’s difficult family circumstances that led him to become involved in the misuse of drugs, his guilty plea and his acceptance of his culpability as mitigating factors.

Also taking into account that the accused is a father of a one with another child on the way, Judge O’Donnell said he had to treat the matter seriously and sentenced him to three years in jail.
