« BackSentencing of Tralee brothers guilty of assault on uncle adjourned

The sentencing of two Tralee brothers who were found guilty of a serious assault on their uncle four years ago has been adjourned to allow for a new medical examination of the victim.

Last May, Thomas Kelly of 138 Marian Park, Tralee and Robert Kelly of 8 Ogham Rian, Tralee were found guilty of causing serious harm to Gerald Fitzgerald at his home at 38 Mitchel’s Road on November 8th, 2011.
The trial heard details of the assault on Mr Fitzgerald which followed the consumption of large quantities of alcohol and during which the victim sustained damaged to his back passage caused by the handle of a tennis racket.
Sentencing had been scheduled for this week, however Judge Tom O’Donnell was told that a new medical examination was to be carried out and this would not likely be ready before the end of the current law term.
The case was adjourned for mention to October 12th at Tralee Circuit Court.
