Kerry Co-Op has proposed that a test case be taken following letters from Revenue being sent to 400 Kerry milk suppliers.
The correspondence outlined a tax liability for patronage shares for the years 2011, 2012 and 2013.
The liabilities range from 5,000 to 50,000 euro and the suppliers have 21 days in which to reply.
Kerry Co-Op held an emergency meeting on Friday where it was agreed to write to Revenue.
The letter includes a request for a test case to be taken for one of the suppliers; if this is granted it is hoped proceedings by Revenue would be frozen pending the outcome of the case.
