A now 22-year-old Kenmare man has been jailed for 16 months for having sex with a female under the age of 15 with whom he had a relationship when both were teenagers.
Marcin Kaczmarek of Lodgewood, Kenmare, will also be placed on the sex offenders register for a period of ten years
Last May, Marcin Kaczmarek pleaded guilty to two counts of defilement and one of sexual assault between January and March 2014 at a sports pitch in Co Kerry.
The relationship, including regular sexual intercourse, between Mr Kacamarek who was 19 at the time of the offences and the 14-year-old girl was fully detailed in a diary she kept; it came to light when her father read the diary.
At the sentencing in Tralee Circuit Criminal Court yesterday, Judge John Hannan said the gulf in years between them was great.
He referred to the victim impact statement of the now 17-year-old woman, who said she’d been physically and mentally ill as a result.
However, the judge also said there was no evidence of predatory behaviour or grooming.
In mitigation, he noted Mr Kaczmarek had pleaded guilty early, had no previous convictions, had never come to the notice of gardaí; and was a very low risk of re-offending.
Judge Hannan sentenced him to four years, but suspended 32 months, which means he’ll be jailed for 16 months.
He’s been placed on the sex offenders register for 10 years, and will be supervised by the probation service for four years on release.
