« BackJury finds woman not guilty of assaulting garda causing her harm at Tralee hostel

A 40-year-old woman has been found not guilty of assaulting a garda causing her harm at a Tralee hostel.

Sorcha Burgess of no fixed abode had pleaded not guilty to the offence at Finnegan’s Hostel on Denny Street on October 22nd, 2014.

It took a jury at Tralee Circuit Criminal Court less than two hours to find Sorcha Burgess not guilty of assaulting Garda Linda Brosnan causing her harm.


The garda, who attended a disturbance, had alleged she was bitten on the left hand by the accused.


The alleged incident happened at Finnegan’s Hostel where the accused had been a resident.


Hostel owner Eileen Nolan, who was not on the premises at the time, was contacted by telephone by the night porter.


She told the trial Ms Burgess  had been asked to leave because her rent was overdue and she was causing disturbance to other guests.


On October 22nd, 2014 Ms Burgess returned to the hostel and was demanding to be left in to get her belongings.


Garda Brosnan said the alleged assault had taken place after she escorted her inside to get her belongings.


The garda said the accused had scraped her right hand and bit her on the left hand when she had tried to take her room key, and had to be restrained.


She said she started kicking and was very aggressive and nearly had to be carried down the stairs.
