A Kerry TD is calling on the Garda Commissioner to apologise to Deputy Clare Daly.
It follows the publication of a report by the Garda Ombudsman.
Deputy Martin Ferris says Commissioner Noirín O’Sullivan should apologise to Clare Daly for how she was treated by Gardai and the breach of her right to privacy when she was stopped and breathalysed in 2013.
Deputy Daly was later found to have been under the limit.
The incident was widely reported in the media.
The Garda Ombudsman says it is “probable” that information about the arrest was wrongly leaked from within the Gardaí.
However, GSOC wasn’t able to find enough evidence of a criminal offence to warrant sending a file to the DPP.
Deputy Martin Ferris has called on the Commissioner to take action to prevent members of the Gardai or staff in Garda premises from using the PULSE system in an inappropriate manner.
