« BackEast Kerry man fined for burning car tyres on bogland

A 59 year-old garage owner has been convicted and fined for dumping and burning tyres on private land in east Kerry in April 2014.

Sean McCarthy of Knockaninane West, Kilcummin, Killarney was charged with the offence under waste management legislation.

Killarney District Court heard that on 21 April 2014, Sean McCarthy had driven a truck to privately owned bogland at Raheen, Headford.

The vehicle, which had been left with Mr McCarthy for servicing, was being driven without the owner’s knowledge and was transporting about 20 car tyres.

He dumped the tyres on private land and set them alight about 150 metres from a house, the court was told.

The landowner asked Mr McCarthy to extinguish the fire.

Mr McCarthy said he was just tidying up his yard and had never done anything like it before.

Alan Kennelly of Kerry County Council, who attended the scene, told Judge James O’Connor that he had spent 29 hours working on the case which incurred costs to the council of €1,818 based on an hourly rate of €51.31.

Judge O’Connor fined Sean McCarthy €350, ordered that he pay the council’s costs which he set at €1,550 and that he pay €1,000 in compensation to the landowner.
