« BackBord Pleanala upholds council decision on Killarney building use

An Bord Pleanala has upheld a decision by Kerry County Council that the use of a building in Killarney as a craft brewery is development.

Killarney Brewing Company Limited had referred the case to the planning appeals board in May 2015.

planning drawings 4The appeal centred on whether the use of part of the Kerry Mineral Water Supply building as a craft brewery is or is not development or is or is not exempted development.

In May of last year Kerry County Council issued a declaration stating that the development was not exempted; An Bord Pleanala has upheld this.

It said Killarney Brewing Company Limited had not provided sufficient information that the pre 1964 industrial use of the building was not abandoned after 2002 and has been used for warehouse and office use.

The report adds that the recommencement of brewing use is development by reason of being a material change in use and for which there is no express exemption provided in planning legislation.
