Killorglin woman accused of making false rape allegation

Tralee Circuit Court has heard how a woman who claimed she had been raped in Killarney later told Gardai she hadn’t been.

26-year-old Jacinta O’Connor of 3 Steele Row, Killorglin is charged with knowingly making a false report at Killarney Garda Station that an offence had occurred on 22nd September 2014.

The case is being heard before a jury of nine women and three men.

Garda Breda O’Donoghue told the court Jacinta O’Connor said she began her day at a christening and later that night she drove with friends to Killarney.

After visiting a number of pubs the group ended up in the Grand.

When the premises closed, Ms O’Connor said she got separated from her friends and she returned to the Fairhill carpark where her car was parked.

While there she alleged a man wearing a green hoodie, who spoke in a foreign accent, grabbed her and dragged her behind the courthouse, where he raped her.

After the incident Ms O’Connor got dressed but left her bra behind; it would later be found by investigating Gardai.

She went to Killarney Garda Station to make a complaint and was brought to the Sexual Assault Treatment Unit.

Clinical Nurse Manager at the unit, Finola Tobin told the court she observed redness and mud on the accused’s body along with some bruising and abrasions.

When presented with CCTV footage, Ms O’Connor told Garda O’Donoghue that she hadn’t been raped but had consensual sex with another man Michael Ahern, whom she knew previously, in the underground carpark of Scotts.

Under cross examination Mr Ahern said the sex was in no way violent and he would be fairly certain it wouldn’t have caused Ms O’Connor injury.

Ms O’Connor said the sex had been rougher than expected, she found herself alone, with no way home and went to the garda station.

Ms O’Connor told Garda O’Donoghue she was really sorry for what she did and didn’t want the Gardai to do any more investigations.

Gardai identified and interviewed the man the accused alleged to have raped her; he denied any form of sexual contact with Ms O’Connor.
