Killarney man pleads guilty to gain by deception

Gavel 1The jury has been discharged in the trial of a man accused of gain by deception at Tralee Circuit Criminal Court.
Patrick O’Brien, of 122 Ballyspillane, Killarney, was accused of two counts of gain by deception at Coolick, Kilcummin, Killarney on July 23rd 2013 and July 25th 2013.
Mr O’Brien was accused of falsely stating €2,000 was necessary for the purchase of materials in the repair of a roof for Mr Patrick O’Sullivan on July 23rd, 2013.
The court also heard the accused sought additional payment of €2,400 from Mr O’Sullivan for ‘wages and materials’ on July 25th, 2013.
Mr O’Sullivan, who is 80 years of age, wrote cheques for said amounts, made payable to Helen O’Brien, the spouse of the accused.
Mr O’Brien initially denied the charges, but changed his plea to guilty.
Judge John Hannan subsequently discharged the jury and thanked them for the service.
He remanded Mr O’Brien on bail, pending a victim impact statement, for sentencing on May 11th, 2016.
