A High Court case involving a prisoner from Kerry has been dismissed. The high court judge ruled that while the prisoner did suffer a savage blow to his face while in prison in Cork, the authorities could not be held responsible for it. 34 year old Anthony Breen from banna, Tralee, but now living in England, brought the case against the state and cork prison for an injury he sustained to his cheek and jaw. The injury occurred when he was attacked while on remand at the prison on February 11th 1998. Making his ruling Mr Justice John Smyth said it was a sudden and unprovoked attack which the prison authorities could not have anticipated.
