The High Court will hear an application from the Government next week to use Judge Brian Curtin`s computer as part of the Oireachtas investigation. Yesterday, lawyers for Judge Curtin tried to stop the proceedings from going ahead, but Justice Kelly ruled that it raised important legal issues and they should take place.Last month the Minister for Justice moved a motion for the removal of the Judge for stated misbehaviour. This led to a court challenge from Judge Curtin, whose legal team argued that the computer and other materials were unlawfully removed and could not be used. The Government’s case is that as it’s an Oireachtas Investigation, the Courts cannot rule in the Judge’s favour. The hearing opens next tuesday.
