A man accused of using a mobile phone while being the driver of a car that was being towed has had his case dismissed. 43 year old Dermot Buckley of Knocknagullane, Rathmore was accused of holding a mobile phone while being the driver of a mechanically propelled vehicle on 15 May 2015 at Gortahaneboy East, Rathmore. However when the case was called, his solicitor Pat F O’Connor pointed out that his client was in the towed vehicle – and the vehicle in question was “not capable of mechanical propulsion.” Judge James O’Connor agreed and dismissed the case.
